Pictura Privacy Policy

Pictura provides AI photo features such as upscaling, restoration, colorization, filters, and headshots. This Privacy Policy explains what data we process, how we use it, and when we share it with third parties to provide the service.

We do not sell personal data and we do not use your photos, prompts, or outputs for advertising.

Pictura does not collect or create biometric face data, faceprints, facial-geometry templates, identity profiles, or face-recognition identifiers. Pictura does not use faces to identify, authenticate, track, or profile a person.

A photo selected or captured by a user may visibly contain a face. In that case, the pixels depicting the face are processed only as part of the complete image to perform the editing feature the user requests. Some enhancement and restoration tools analyze facial regions to preserve or improve their visual appearance, but they do not determine identity or create a reusable face record. Pictura does not retain face information separately from the image.

On-device features do not send the selected image to an AI provider. To provide a cloud AI feature requested by the user, Pictura sends the minimum content needed through AIProxy, our API gateway, and then only to the provider used by the selected feature:

Some models offered through fal.ai, including ByteDance Seedream, run within fal.ai's service.

Important notes about third parties

Cloud content is processed on systems operated by AIProxy and the selected provider. These systems may be located in the United States or other countries where the provider or its subprocessors operate. Pictura does not maintain a separate server-side database of user images.

Third-party providers process data according to their own terms, privacy policies, and the retention periods described below.

We do not authorize third parties to use your content for advertising on our behalf.

We do not use your submitted images or prompts to train our own models.

Before any photo/image or optional text is uploaded for third-party AI processing, Pictura requests your consent in-app.

Where required by applicable law, we rely on your consent and service performance necessity to process content needed to deliver requested AI features.

Pictura downloads the result to the user's device when processing finishes and does not intentionally keep a server copy. The providers' standard retention periods apply to cloud requests, including any face visible in an image:

Provider retention periods may change when a provider updates its service. Pictura will update this policy when it becomes aware of a material change. A provider may retain information longer only when legally required.

To delete on-device images immediately, delete the item or clear the in-app history. To request deletion of identifiable provider-side request data before its automatic expiry where supported, contact jonathan.benavides@suyai.ch and include the approximate date/time, feature used, and country/storefront.

Depending on your location, you may have rights to request information about how data is handled and to request deletion.

There may be limited provider-side data available to access or delete after an automatic retention period has expired.

You may withdraw consent for future AI uploads under Settings > Privacy > Cloud AI Data Sharing or by uninstalling the app. Withdrawing consent disables cloud AI features but does not affect on-device editing.

12) Consent to Share Consumption Data with Apple

By using our app and making in-app purchases, you consent to our sharing of data regarding your usage and consumption of purchased content with Apple, as part of our efforts to resolve refund requests. This information may include details about how you have accessed and interacted with the purchased content. The purpose of sharing this data is to help Apple make an informed decision regarding refund requests. We ensure that such data sharing is done in compliance with Apple's policies and only as necessary to process your requests.

Pictura's App Store privacy disclosures (including privacy nutrition labels) are intended to match this Privacy Policy, including disclosure of cloud processing through AIProxy with fal.ai, Replicate, OpenAI, and Google Gemini, and crash diagnostics with Firebase Crashlytics.

We may update this Privacy Policy from time to time. The updated version will be posted in-app or on our website with a revised Effective Date. Continued use of Pictura after an update means the updated policy applies.
